Rape Charges Dismissed in Joliet Man's Case

DNA proved Nakita Ulmer could not have been responsible for the sexual assault and an appellate court upheld a judge's ruling that new evidence couldn't be introduced.

Charges have been dismissed against a Joliet man who spent 17 months in the Will County jail for a sexual assault that DNA showed he did not commit.

Nakita Ulmer, 26, was arrested Oct. 15, 2009, and charged with home invasion, robbery, aggravated criminal sexual assault and aggravated criminal sexual abuse in connection with the attack of a 62-year-old Joliet woman, according to a story in the Joliet Herald News.

He was released from jail in March 2011 when a DNA expert said the evidence collected could not have belonged to Ulmer, the story said.

The Will County State's Attorney's Office attempted to later introduce new evidence showing that Ulmer had an erectile disfunction pill in possession at the time of his arrest, supporting the victim's claim that her attacker was having trouble maintaining an erection, the story said.

When the judge would not allow the new evidence, the issue was appealed to the appellate court, which agreed with the judge in a ruling issued Jan. 8, the story said.

Thank u darla black lopez.. Kita is my first cousin & although we havent spent alota time together as a family.. Hes free of all charges.. He has a life just like every one else & has raised his son since birth with the help of his sister & mother, i will say sorry 4 what happened 2 the ladie but kita is free at last free at last.. Your so welcome butterfly ! These police need to get there shit straight. Many times my son who's a jjc student has been thrown up against police cars,1 x a house got spray painted and my son was walking home from school they seen his backpack threw him to the ground kneeling on his neck and threw his books all over the street.when they found nothing they let him there to gather his books as they took off,the next day my son couldent move is neck after docs he had to wear a neck brack.another time a house was robbed of a xbox my other son was walking with a bulky jacket they stopped hime threw him to the car busting his lip and leaving red marks on his chest later the next day big black and blue marks appeared all on his chest! Iam so tired of how police and courts treat people.god bless ! May him and his son prosper and live in peace

Again thanks darla, we need more supportive people in this town instead its full of stereotyping... Smh at jpd... That was enough to traumatize the 2 boys as well as my cousin.. I wish & your boys well n hopefully it wnt happen again
